TERMS & CONDITIONS
These Terms and Conditions of Trading apply to all consumer contracts between Camerich UK Limited and our subcontractors ("us/we/our") and the Customer ("you/your") in relation to all sales of goods and services.
1. Product Specifications
1.1 We have a policy of continuous product development and reserve the right to amend the specification of products without prior notice in relation to future sales.
1.2 Goods supplied may differ from those on display or advertised. Unless agreed with you, the goods supplied will be of equivalent value, functionality and appearance. Any significant variations will be highlighted on the display model.
1.3 Leather goods are made from quality natural leather and accordingly they may not be uniform in colour or texture. Only the finest hides are selected but they will show natural marks and scars on the hide. Some leathers will mellow with age and exposure to sunlight and heat.
1.4 We will endeavour to match the colour and texture of the fabric of your sofa to the samples chosen as accurately as possible, but variations in both the colour and texture may occur. Some fabrics will mellow with age and exposure to sunlight and heat.
1.5 Some self-assembly may be required on certain products.
2. Measurements
2.1 You must ensure that furniture ordered can be delivered into your property and that there is safe and reasonable access from the public highway to the place of delivery. Awkward access deliveries such as hoisting, removing window frames and doors are priced on request. Please call our delivery team (Atlas of London) on 0800 028 6375 for a quote. Atlas can arrange for an access check prior to delivery, but you will incur an additional charge for this service.
2.2 The measurements of all furniture and furnishings made by us will be as accurate as possible, but are nevertheless approximate.
3. Prices
3.1 All prices include VAT, where appropriate, at the prevailing rate and are subject to any promotional offer or discount.
4. Payments
4.1 In the case of stock items, whether currently in our warehouse or in transit, must be paid for in full at the point of purchase. A 50% deposit is required for custom order items, with the balance due upon arrival to our UK warehouse. Only once we have received the balance of any monies due in cleared funds, will our logistics company be able to confirm your actual delivery date.
5. Delivery
5.1 When your purchase is in stock in our UK warehouse, our logistics company will contact you to arrange delivery within 48hrs (exc. weekends). We must be able to deliver the furniture into your home within 14 days thereafter. If we are unable to do so due to your default, our logistics company may make a charge for storing the furniture beyond this point, which is payable in advance. They will advise you of this charge at the relevant time.
5.2 Our standard free delivery includes assembly of the furniture and removal of packaging (which is taken away to be recycled). All deliveries are carried out by insured and qualified professionals. A two-hour delivery window is given as standard. Our delivery charges are as follows: Free delivery for orders over £500 within M25; £75 for orders under £500 within M25; £50 per item for disposal of unwanted furniture; £50 surcharge for delivery guaranteed before 8am; £50 surcharge for a Saturday delivery; £75 + £2 per mile from the Islington showroom to the destination for orders outside M25; Worldwide delivery quotes available on request. We reserve the right to review and amend the aforementioned charges at any time.
5.3 If you are unable, for whatever reason, to take delivery of your goods on the confirmed delivery date, we reserve the right to charge you further for any subsequent deliveries.
5.4 You are responsible for providing a safe and reasonable means of access from the public highway to the place of delivery. If our delivery staff considers that access is unsafe, then we will not deliver the goods until safe access is provided. You are obliged to provide any required parking permits in advance.
5.5 If it becomes apparent during delivery that stock items you have ordered will not fit, you may return them (fully boxed) with the delivery team and receive a full refund less £75.00 (or the original cost of your delivery, whichever is the greater) to cover the aborted delivery and any re-stocking fees. Please note that if you request that the delivery team attempt to complete the delivery by removing the items from their packaging, you will forfeit your right to return as we can only accept goods in their original packaging. Custom orders cannot be refunded or returned.
5.6 Camerich UK Limited accept no liability for any damage to persons or property during the course of delivery.
5.7 Time of delivery is not of the essence in these Terms and Conditions of Trading. We will not be liable for any direct or indirect loss of profits or other financial loss or damage suffered by you through any reasonable delay or delay due to unforeseen circumstances outside of the reasonable control of Camerich UK Limited or delay due to any reasonable rescheduling of delivery.
6. Returns and Refunds Policy
6.1 If you have ordered a stock item and have not yet arranged for it to be delivered, then you may cancel and receive a full refund. If you have already arranged delivery of a stock item, you will be charged a cancellation or rearrangement fee of £75.00 if you cancel within 3 days prior to the arranged delivery date. This fee will be charged regardless of whether you wish to cancel the whole of your order or just the delivery itself.
If you have ordered and received delivery of a stock item, we are happy for you to return it to us in a fully saleable (as new) condition still in its packaging within 14 days. A re-stocking and handling charge of 30% of the purchase price will be charged. This charge includes collection within M25. Outside M25 an additional charge of £75.00 + £2 per mile to the collection address from the Islington showroom will apply should you wish us to collect the goods. Returns are all to our Hertfordshire based warehouse - not to the showroom.

This Returns and Refunds policy applies to stock items only - once an order is made and paid for in a custom size or fabric, it cannot be cancelled or returned. This does not affect your statutory rights.
7. Guarantees
7.1 The provisions of this clause 7 apply in addition to your statutory consumer rights in relation to faulty or miss-described goods. These rights are not affected by the guarantee.
7.2 All our furniture comes with a free 5-year guarantee against faulty workmanship and/or faulty materials. The guarantee does not cover fillings and coverings.
7.3 Guarantees may not be transferred.
7.4 These guarantees do not cover fair wear and tear, neglect, abuse or misuse of your goods, loss or damage (including rusting and corrosion) due to unreasonable exposure to water, heat or weather; loss or damage due to fire, smoke, explosion, lightning, sunlight, infestation by animals or boring insects, or theft, or accidental damage or loss caused by a third party.
8. Claims Under Guarantee
8.1 In the event of a claim under guarantee occurring, please contact our Islington showroom and ask for the Retail Sales Manager, or e-mail us at sales@camerich.co.uk with the following information: - your sales invoice number, your address and contact details and a summary of the problem, including photographic evidence where appropriate.
8.2 We will endeavour to repair the defective goods free of charge. If a repair is not possible you will be offered a replacement and only if a suitable replacement is not available will you be offered a refund.
8.3 We will not be liable for any direct or indirect loss of profits or other financial loss or damage arising out of defective, damaged or wrongly delivered goods, over and above the value of the goods themselves. This does not affect your statutory rights.
8.4 Our guarantees are limited to goods sold and retained in the United Kingdom (including Northern Ireland), and used solely for private and domestic purposes.
9. Ex-Display and Clearance Items
The following Terms and Conditions apply only to Ex-display and Clearance Item purchases. In the event of conflict, these Terms and Conditions set out in this clause 9 prevail.
9.1 Payment must be made in full at the time of the purchase.
9.2 Purchases will be delivered within 14 days from the date of purchase. You will be notified of the delivery date as soon as possible after the time of purchase. You will be notified of the delivery charges at the time of your purchase.
9.3 You should thoroughly inspect the furniture prior to purchase. No refunds will be given, unless the goods are faulty. This does not affect your statutory rights.
10. Applicable Law
10.1 These Terms and Conditions of Trading are governed by and are to be construed in accordance with the laws of England and Wales.
